TERMS OF SERVICE

MUSTO’S PAINT SHOP TERMS OF SERVICE

1. A contract will be binding between Carlo Musto T/A Musto’s Paint Shop (from this point on known as Musto’s Paint Shop) and the customer upon the booking of or arrival of the vehicle on site (whichever is first) for “accident repair, estimate/assessment and/or car service” or any other repair.

2. If you place an order or make a booking via the phone or internet or in person you warrant that you are legally capable of entering into a contract of sale and you are at least 18 years old and reside in the UK.

3. Musto’s Paint Shop will provide details of the cost of each car body/paint repair, car service and any mechanical work required before the work is done. All work and costs, including additional work must be approved by the customer before any work is carried out. Any estimate given for such work will be valid for a period of 90 days and is subject to physical inspection of the vehicle and parts prices remaining the same.

3A. Estimated costs of parts are subject to change due to suppliers costs and every effort will be made to inform the customer of any change to pricing as soon as possible. A supplementary estimate will be submitted to the Customer where the increase in the price of the work is 10% or more. Such work shall not be undertaken nor parts and materials used without the prior approval of the Customer.

4. Electrical system and components.Due to the complexities of today’s vehicle electrical systems and components, responsibility will not be accepted under any circumstances for error codes, malfunctions or related electrical problems manifesting during and after work has commenced.”Misting” of headlights on the Bentley Continental is a well documented manufacturing problem and is not covered by our warranty. In the event of any component failure it is the customers responsibility the return the vehicle onsite for inspection and if required, rectification or replacement.

5. Musto’s Paint Shop reserves the right to take images of vehicles on site for purposes of commercial use and/or marketing without prior consent. Objections are required to be made before commencement of repairs in writing. All images taken are protected by copyright law and cannot be copied, downloaded nor altered in any way without the prior written consent of Musto's Paint Shop. Customers are also advised that it is strictly forbidden to take images of vehicles, staff or premises without prior written consent.

6. If the repair cannot be done within the quoted timespan due to circumstances beyond Musto’s Paint Shop’s control, contact will be made to the customer and inform them accordingly – this may sometimes be due to parts not being delivered or available, or the work required may take longer to complete due to additional damage or other. Musto’s Paint Shop cannot be held responsible for any charges incurred by the Customer due to any such delay nor bear responsibility for replacement vehicles or hire charges.

7. All parts used will adhere to the manufacturers service schedule and warranty and will be of “original equipment” (OE) standard – ensuring all warranties are validated, unless otherwise agreed with the customer, whether verbally or in writing.

8. Parts supplied by the customer are subject to prior approval by Musto’s Paint Shop, however liability falls with the customer should those parts a. not fit correctly, B. not work correctly, or c. cause damage to the vehicle at a later date once the vehicle has been collected and removed off site. Musto’s Paint Shop does not accept any liability for any damage or losses suffered by the Customer caused by parts supplied by the customer themselves.

9. Vinyl graphics are fitted to customer’s vehicles at the owners risk.

9A. Due to the single application nature of vinyl graphics, refunds are not available for correctly applied vinyl to the customers specification if the customer later decides they do not like the design/effect.

9B. Factory painted cars are the ideal bed to install vinyl graphics onto, but there is a risk with resprayed vehicles/parts of vehicles, with badly painted or poor condition paint work, that paint may come away with vinyl when removed.

We stress that Musto’s Paint Shop cannot be held responsible for any paintwork coming away or deeper cut marks being present.

9C. We take great care in not leaving marks or scratches when fitting vinyl to vehicles, however in some cases, graphics that require hand cutting or trimming when on the vehicle may sometimes leave a visible surface line that, on vinyl removal, may need minor repair, this is especially the case in newly painted vehicles, we advise that 3 weeks minimum be left between painting & any form of graphics being fitted.

9D. Musto’s Paint Shop will not be held responsible for any damage caused in any way due to fitment or removal of third party graphics which are supplied by the customer.

This includes any paintwork damage whatsoever, paint removal, paintwork damage or cut marks being more prominent or visible.

9E. Musto’s Paint shop cannot offer any warranty or guarantee against the fitting of third party graphics supplied by the customer.

10. Whilst every effort will be made to locate and deal with areas of corrosion, Musto’s Paint Shop cannot guarantee that corrosion present within the metal, but which is not visible, will not become evident during the usual warranty period and thus affect the exterior finish of the vehicle.

11.Disclaimers will be provided for and agreed/signed by the customer before Musto’s Paint Shop undertake any work falling into the category of ‘vinyl removal’ or ‘corrosion treatment’. The Disclaimer will outline the risks involved and place the liability with the customer should they wish Musto’s Paint shop to go ahead with the work.

12. While Musto's Paint Shop will make every effort to treat and repair areas of corrosion effectively, due to the nature of corrosion itself it can not be guaranteed the corrosion will not return at a later date. Musto's Paint shop offer a 60 day guarantee from the date of treatment, and will re-treat any returning corrosion free of charge within this time period. Any returning corrosion requiring treatment after this time period will be subject to full charge.

12A. In cases of severe corrosion Musto's Paint Shop may advise to remove and replace the effected area. If the customer chooses not to do so, the above guarantee does not apply and no guarantee will be given against returning corrosion.

13. In certain cases, Musto's Paint Shop will advise and recommend specific methods of repair, paint work and materials. Should the customer decide not to take the recommendation given and request Musto's Paint Shop to proceed with unrecommended repairs/paintwork/materials, Musto's Paint Shop take no responsibility for any future outcome or defect that may occur as a result of following the customers wishes.

14. Once the car body repair or car service has been finished, payment will be taken directly after either by debit card, credit card, BACS or cash. Once payment has been received, the car will then be available for collection by the customer. Possession of the vehicle will NOT be passed back to the customer until the customer has paid for the cost of the works. If payment is not made, Musto’s Paint Shop is entitled to charge reasonable storage costs as listed below. All goods/parts fitted to vehicles remain the property of Musto’s Paint Shop until invoices are paid in full.

Vehicles that remain on site for over 72 hours post completion or for any other reason without prior agreement either in writing or verbally from Musto’s Paint Shop shall be liable for storage charges in line with government guidelines.

After 6 months in storage vehicles will be deemed as abandoned and Musto’s Paint Shop reserve the right to start the process of disposal of the vehicle to recover any unpaid invoices/ charges. While this takes place, the vehicle will be moved to offsite secure storage due to limited space and charged at £50 per day. The vehicle owner will be liable for transport costs, administration, engineer's reports, valuations etc to assist in the disposal on the vehicle. Customer will be liable for any shortfall still outstanding after this process, any additional funds over the outstanding charges will be returned to the customer.

For the avoidance of doubt Musto’s Paint Shop do NOT provide free storage to customers/companies under any circumstances unless agreed in writing in advance by a director of Musto’s Paint Shop. It is the customers/owners /companies responsibility to ensure vehicles are collected with 72 hours of when work is complete or Musto’s Paint Shop requests the vehicle is removed from site (for example due to total loss, customer not proceeding with work, insurance company moving to another garage, customer keeping vehicle salvage, hire/lease cars left on site etc).

14A. Customers personal items and/or remaining parts will be kept for up to fourteen days after which time they will be disposed of. No responsibility for loss or damage will be accepted after such time.

15. Musto’s Paint Shop do not accept any liability for any damage or losses suffered by the Customer from the storage of its vehicle at the garage or at our secure storage site. Musto’s Paint Shop cannot be held responsible for deterioration of vehicles while in storage such as getting dirty if exposed to the elements, flat batteries, flat tyres, air suspensions dropping, electrical faults developing due to lack of use etc

16. Force Majeure. Musto’s Paint Shop shall not be liable in the event on non-fulfilment of a contract owing to an Act of God, war, disease, strike, lockouts, fire or any accident or incident of any nature whatsoever, beyond the control of the Company. All valuables are required to be be removed and are the responsibility of the owner. Musto's Paint Shop does not accept any responsibility for vehicles left on the premises 72 hours after notification of completion of repairs, unless by prior written or verbal agreement.

17. The customer has the right to cancel the car body repair or car service at any time, as long as any of the agreed work to date has been paid for up to the point of cancellation. If work has not been started or in relation to insurance work the customer is found to be at fault or a false/fraudulent claim the customer will be liable for recovery, estimating costs and daily storage charges. It will be the customer’s responsibility to collect these costs from their insurance company. All work carried out for customers referred by accident management companies shall be invoiced to the customer and they will remain liable for all charges if not settled by the accident management company.

17A. The customer is also responsible to pay for any parts which are ordered at their request (special orders), should they decide not continue with the repair.

18. All legal notifications or unsolicited contractual communications shall be delivered either in person or by registered means. Electronic mail is not an accepted method of communication nor deemed served unless by prior written arrangement.

18A. Unsolicited contractual communications of any kind shall not constitute an acceptance nor recognised by the Company unless first signed and agreed.

18B. We reserve the right to charge administration fee’s for legal consultation and interpretation costs prior to application and/or enforced issuing of government licence’s, compliance forms, documentation and notices. Issuing agents will be required to provide written acknowledgement and acceptance of aforementioned administration fee’s prior to licence’s, documentation, compliance forms and notices being issued.

18C. The company premises are privately owned and not a public property and as such cannot be held responsible for licences and or notices that apply to the public in general. In accordance to health and safety guidelines the workshop areas are dedicated work zones and off limits to the general public.

Images of vehicles on site may be only be taken with the express permission of the company. We reserve the right to confiscate equipment in the event of the aforementioned being ignored.
